  《广东省公共机构节能办法》已经2016年4月7日广东省人民政府第十二届71次常务会议通过,2016年4月30日公布,自2016年6月1日起施行。

  These Measures of Guangdong Province on Energy Conservation inPublic Institutionsadopted at the 71stExecutive Meeting of the 12thSession of the People’s Government of Guangdong Province on April 7, 2016 are hereby promulgated on April 30, 2016 and shallbecame effective as of June 1, 2016.

  Measures of Guangdong Province on Energy Conservation in Public Institutions

  

  第一章总则

  Chapter I General Provisions

  第一条为了推动本省公共机构节能,提高能源利用效率,充分发挥公共机构在全社会节能中的表率作用,根据《中华人民共和国节约能源法》《公共机构节能条例》《机关事务管理条例》等法律法规,结合本省实际,制定本办法。

  Article 1

  These Measures are formulated for the purposes of promoting energy conservation in public institutions of this Province, enhancing their energy utilization efficiency and giving play to their model role in the energy conservation of the whole society in accordance with such laws and regulations as the Law of the People’s Republic of China on Energy Conservation, the Regulations on Energy Conservation in Public Institutions, the Regulations on the Administration of the Institutional Affairs of Government and in light of the actual situation of this Province.

  第二条本省行政区域内的公共机构节能工作,以及对公共机构节能工作的推进、指导、协调和监督,适用本办法。

  Article 2

  These Measures shall apply to the energy conservation work of public institutions within the administrative region of this Province as well as the promotion, guidance, coordination and supervision for the energy conservation work of public institutions.

  本办法所称节能,是指公共机构通过节约集约利用能源,加强能源利用的全过程监督管理,提高电、气、煤、油、热力和水等的利用效率和效益,减少和杜绝浪费的行为。

  For the purpose of these Measures, the term “energy conservation” means the acts that public institutions enhance the efficiency and benefit of utilizing the energy of, inter alia, electricity, gas, coal, petroleum, heating power and water through intensively and economically utilizing energy resources and strengthening the supervision and management of energy use in the whole process, so as to reduce and eliminate acts of wasting energy resources.

  第三条省人民政府管理机关事务工作的机构在省人民政府管理节能工作的部门指导下,负责全省公共机构节能的推进、指导、协调和监督工作。

  Article 3

  The office for administering institutional affairs of the provincial people’s government shall be responsible for promoting, guiding, coordinating and supervising the energy conservation work of public institutions of this Province under the guidance of the administrative department of energy conservation of the provincial people’s government.

  市、县(区)人民政府管理机关事务工作的机构在同级人民政府管理节能工作的部门指导下,负责本级公共机构节能的推进、指导、协调和监督工作,并指导下级公共机构节能工作。

  The office for administering institutional affairs of the people’s governments at the municipal and county (district) level shall, under the guidance of the administrative department of energy conservation of the people’s government at the same level, be responsible for promoting, guiding, coordinating and supervising the energy conservation work of public institutions at the same level and for guiding the energy conservation work of public institutions at the lower level.

  县级以上人民政府教育、科技、司法、文化、卫生计生、体育等部门,在同级管理机关事务工作的机构指导下,负责本级系统内公共机构节能工作。

  Such authorities as departments of education, science and technology, judiciary, culture, health and family planning, and sports of the people’s governments at the county level or above shall, under the guidance of the office for administering institutional affairs at the same level, be responsible for the energy conservation work of public institutions within the corresponding field.

  实行省以下垂直管理的部门在省人民政府管理机关事务工作的机构指导下,负责本系统内公共机构节能工作。

  The departments under the vertical administration below the provincial level shall, under the guidance of the office for administering institutional affairs of the provincial people’s government, be responsible for the energy conservation work of public institutions within the corresponding field.

  乡(镇)人民政府、街道办事处应当按照本办法以及上级人民政府有关部门的部署,做好公共机构节能监督管理工作。

  People’s governments at the township level and sub-district offices shall supervise and manage the energy conservation work of public institutions in accordance with the provisions of these Measures and the arrangement of relevant departments of the people’s government at the higher level.

  第四条公共机构节能工作应当遵循合理利用、勤俭节约、绿色低碳、保护生态环境的原则。

  Article 4

  The energy conservation work of public institutions shall follow the principles of rational utilization, diligence and frugality, green and low-carbon, and protection of ecological environment.

  第五条对在公共机构节能工作中做出显著成绩,或者检举严重浪费能源行为的单位和个人,应当按照国家和省的有关规定给予表彰和奖励。

  Article 5

  The units or individuals that have made outstanding achievements in the energy conservation work of public institutions or that have reported the acts of prodigiously wasting energy resources shall be honored and rewarded in accordance with relevant national and provincial provisions.

  第二章公共机构节能责任

  Chapter II Responsibilities of Public Institutions in Energy Conservation

  第六条公共机构应当采取技术上可行、经济上合理、环境和社会可以承受的措施,有效、合理地加强用能管理,降低消耗,减少、制止浪费。

  Article 6

  Public institutions shall take measures that are technologically feasible, economically rational and bearable to the environment and the society in order to strengthen the management of energy use in an efficient and reasonable way, to cut down energy consumption, and to reduce and restrain from energy waste.

  第七条公共机构应当建立健全本单位节能管理制度,加强对用能系统和设备的运行调节、巡视检查和维护保养,推行低成本节能管理措施,重点加强智能化节能措施的推广。

  Article 7

  Public institutions shall set up and improve an energy conservation management system, enhance the operation, adjustment, inspection, check and maintenance of energy use system and equipment, carry out low-cost measures for the management of energy conservation, and lay emphasis on the promotion of intelligent energy conservation measures.

  第八条公共机构应当依据本行政区域节能规划和节能目标、任务要求,结合本单位用能特点和上一年度用能状况,制定年度节能目标和实施方案,并组织落实。

  Article 8

  Public institutions shall, based on the energy use features and status in the previous year, work out the annual energy conservation objectives and the implementation plan thereof and organize the implementation work therefor in accordance with the planning, objectives and task requirements of energy conservation within the administrative region where they are located.

  年度节能目标和实施方案应当在规定时间内报本级人民政府管理机关事务工作的机构备案。

  The annual energy conservation objectives and the implementation plan thereof shall, within the prescribed time limit, be submitted to the office for administering institutional affairs of the people’s government at the corresponding level for record.

  第九条公共机构应当设置能源管理岗位,实行能源管理岗位责任制。重点用能系统、设备等操作岗位,应当配备专业技术人员,并经过相应的专业培训。公共机构主要负责人应当对本单位节能工作负责。

  Article 9

  Public institutions shall set up energy management posts and implement the system of energy management post responsibility. Technical personnel who have accepted the corresponding specialized training shall be assigned to the operation posts of key energy use systems and equipment. The principal person-in-charge of public institutions shall be responsible for the energy conservation work in such institutions.

  第十条公共机构应当按照规定配备和使用经依法检定合格的能源计量器具,实行能源消耗分户、分类、分项计量,并对能源消耗状况进行实时监测。

  Article 10

  Public institutions shall purchase and use, according to the rules, the energy measuring instruments that have passed the statutory check by law, carry out the household-based, type-based and item-based measurement of energy consumption, and conduct real-time monitoring over the status of energy consumption.

  公共机构应当指定专人负责能源消耗统计,如实记录能源消耗原始数据,建立完整的能源消耗统计台账,并按照规定向本级人民政府管理机关事务工作的机构报送能源消耗状况报告。

  Public institutions shall appoint special personnel to collect the statistical data of energy consumption, truthfully record the raw data of energy consumption, set up a complete statistical ledger of energy consumption, and submit the report on energy consumption status to the office for administering institutional affairs of the people’s government at the corresponding level according to relevant provisions.

  属于重点用能单位的公共机构,依法应当同时向有关部门报送能源利用状况报告。

  Public institutions that are key energy consuming entities shall submit a report on energy utilization status to the departments concerned at the same time according to law.

  第十一条公共机构应当按照规定进行能源审计,对本单位用能系统、设备的运行及使用能源情况进行技术和经济性评价,并根据审计结果采取提高能源利用效率的措施。

  Article 11

  Public institutions shall make the energy auditing in accordance with relevant provisions, evaluate the technological level and economic efficiency of the operation of their energy use systems and equipment as well as the energy utilization status, and take measures for enhancing energy use efficiency based on the auditing results.

  能源审计的内容包括:

  The energy auditing shall include the following aspects:

  (一)查阅建筑物竣工验收资料和用能系统、设备台账资料,检查节能设计标准的执行情况;

  (1) Consulting the materials on completion acceptance of the building, as well as the energy use system and equipment ledgers, and checking the implementation status of energy conservation design standards;

  (二)核对电、气、煤、油、热力等能源的消耗计量记录和财务账单,评估分类与分项的总能耗、人均能耗、单位建筑面积能耗;

  (2) Checking the measuring records and financial bills of the consumption of such energies as the electricity, gas, coal, petroleum and heating power, and making type-based and item-based evaluations on the energy consumption totally, per capita and unit building area respectively;

  (三)检查用能系统、设备的运行状况,审查节能管理制度执行情况;

  (3) Checking the operation status of the energy use system and equipment, and examining the implementation status of the energy conservation management system;

  (四)检查前一次能源审计合理使用能源建议的落实情况;

  (4) Checking the implementation status regarding the suggestions for reasonably using energy as proposed in the previous energy auditing;

  (五)查找存在节能潜力的用能环节或者部位,提出合理使用能源的建议;

  (5) Identifying the potential links or parts for energy conservation, and making proposals on reasonably using energy;

  (六)审查年度节能计划、能源消耗定额执行情况,核实公共机构超过能源消耗定额使用能源的说明;

  (6) Examining the implementation status of annual energy conservation plan and energy consumption quota, and verifying the explanation of a public institution regarding the energy consumption beyond the prescribed quota; and

  (七)审查能源计量器具的运行及周期检定情况,检查能源消耗统计数据的真实性、准确性。

  (7) Checking the operation and periodic verification of energy measuring instruments, and examining the authenticity and accuracy of the energy consumption statistics.

  公共机构能源审计应当由具有专业资质的第三方机构承担。

  The energy auditing of a public institution shall be assumed by a third party with professional qualifications.

  第十二条公共机构应当按照国家和省有关强制采购或者优先采购节能产品和技术的规定,采购列入财政部、国家发展改革委发布的《节能产品政府采购清单》的产品、设备,不得采购国家和省明令淘汰的用能产品、设备,不得使用国家明令淘汰的用能产品和设备。

  Article 12

  Public institutions shall, in accordance with the national and provincial provisions on compulsory procurement or priority procurement of energy-saving products and technologies, purchase products and equipment included in the Government Procurement List of Energy Saving Products issued by the Ministry of Finance and the National Development and Reform Commission. The energy-using product or equipment explicitly eliminated by the state and the authorities of this Province shall not be purchased or used in energy conservation.

  第十三条公共机构应当加强本单位节能宣传和教育,引导工作人员增强依法节能意识和绿色低碳出行理念,培养良好的节能习惯。

  Article 13

  Public institutions shall improve the publicity and education work on energy conservation within their units, and guide staff members to enhance the awareness of energy conservation by law and the idea of using green and low-carbon vehicles and to cultivate good habits of energy conservation.

  公共机构对本单位用能状况应当以适当方式公布,对浪费能源的现象应当及时制止。

  Public institutions shall publicize the energy utilization status in an appropriate way and stop any act of wasting energy in a timely manner.

  第三章节能管理

  Chapter III Energy Conservation Management

  第十四条县级以上人民政府管理机关事务工作的机构应当根据本行政区域国民经济和社会发展规划和上级公共机构节能规划,会同相关部门制定本行政区域公共机构节能规划,并将规划确定的节能目标和指标分解落实。

  Article 14

  The office for administering institutional affairs of the people’s governments at the county level or above shall work with relevant departments to develop the energy conservation plan for public institutions within the administrative region in accordance with the national economic and social development plan of the region and the energy conservation plan of public institutions at the higher level, and shall break down and implement the energy conservation objectives and indicators determined by such conservation plan.

  公共机构节能规划应当包括指导思想、基本原则、能源利用状况和问题、节能目标和主要指标、节能重点领域和工程、实施主体、保障措施等方面的内容。

  The energy conservation plan of public institutions shall consist of such items as the guiding ideology, basic principles, energy use status and problems, energy conservation objectives and major indicators, key energy conservation areas and projects, parties of implementing the plan and safeguarding measures.

  第十五条县级以上人民政府管理机关事务工作的机构应当会同质量技术监督部门建立健全能源计量技术服务机制,指导、督促公共机构逐步完善能源计量器具配备和管理。

  Article 15

  The office for administering institutional affairs of the people’s governments at the county level or above shall work with the quality and technical supervision department to establish and improve the technical service mechanism of energy measurement, guide and urge public institutions to gradually improve the purchase and management of energy measuring instruments.

  公共机构配备和使用能源消耗计量器具,应当符合国家和省有关技术标准和规范要求。

  The purchase and use of energy measuring instruments by public institutions shall meet relevant national and provincial technical standards and specifications.

  第十六条县级以上人民政府管理机关事务工作的机构应当会同有关部门利用现有能源消耗数据采集与监测平台,加快推进公共机构能源消耗监测体系建设,对本级及所辖下级公共机构能源消耗状况实施监测。

  Article 16

  The office for administering institutional affairs of the people’s governments at the county level or above shall work with the departments concerned to use the existing data collection and monitoring platforms of energy consumption and accelerate the construction of monitoring system for energy consumption of public institutions, so as to monitor the energy consumption status of public institutions at the corresponding level and at the lower level.

  县级以上人民政府管理机关事务工作的机构应当会同统计部门建立健全公共机构能源消耗统计制度,按照规定真实、准确、完整、科学统计本级及所辖下级公共机构能源消耗状况,加强能源消耗统计数据审核分析,按照规定时间将上一年度能源消耗状况向上一级人民政府管理机关事务工作的机构报告。

  The office for administering institutional affairs of the people’s government at the county level or above shall work with the statistical department to establish and improve a statistical system for the energy consumption of public institutions, make a true, accurate, complete and scientific statistics for the energy consumption status of public institutions at the corresponding level and at the lower lever according to relevant provisions, make more efforts in auditing and analyzing the statistical data of energy consumption, and submit a report on the energy consumption status in the previous year to the office for administering institutional affairs of the people’s government at the higher level within the prescribed time limit.

  第十七条县级以上人民政府管理机关事务工作的机构应当会同同级有关部门,按照管理权限,根据不同行业、不同系统公共机构能源消耗综合水平和特点,制定能源消耗定额,逐步实施能源消耗定额管理。财政部门应当根据本级公共机构能源消耗定额确定支出标准。

  Article 17

  The office for administering institutional affairs of the people’s governments at the county level or above shall work with relevant departments at the same level, according to their respective scope of authority, to work out energy consumption quotas based on the average level and characteristics of energy consumption by public institutions in different industries and systems, and gradually implement the management of energy consumption quotas. The finance department shall work out the energy consumption expense standards according to the energy consumption quotas of public institutions at the corresponding level.

  第十八条县级以上人民政府管理机关事务工作的机构应当会同有关部门,制定推进社会节能服务机构参与公共机构节能工作的政策措施,鼓励各级公共机构采用合同能源管理模式、公私合作等方式实施既有建筑综合节能改造。

  Article 18

  The office for administering institutional affairs of the people’s governments at the county level or above shall work with relevant departments to formulate policies and measures to promote social institutions of energy conservation to participate in the energy conservation work of public institutions, and encourage public institutions at all levels to make comprehensive reconstruction of existing buildings for energy conservation by such modes as adopting contractual energy management and public-private partnership.

  第十九条县级以上人民政府管理机关事务工作的机构每年应当会同有关部门加强对本行政区域内公共机构节能工作的监督检查,公共机构应当予以配合。监督检查内容包括:

  Article 19

  The office for administering institutional affairs of the people’s governments at the county level or above shall work with relevant departments to make more efforts in supervising and inspecting the energy conservation work of public institutions within its administrative region, and public institutions shall provide cooperation. The items to be supervised and inspected include:

  (一)节能管理制度、年度节能目标和实施方案的制定、落实情况;

  (1) Formulation and implementation status of the energy conservation management system, the annual energy conservation objectives and the implementation plan thereof;

  (二)能源管理岗位设置及岗位责任制落实情况;

  (2) Information on the establishment of energy management posts and the implementation of post responsibility system;

  (三)能源消耗计量、监测、统计情况;

  (3) Information on the measurement, monitoring and statistical information of energy consumption;

  (四)开展能源审计情况;

  (4) The status of energy auditing;

  (五)节能产品、设备采购和使用情况;

  (5) Information on the purchase and use of energy-saving products and equipment;

  (六)开展节能宣传、教育、培训情况;

  (6) Status of the energy conservation publicity, education and training;

  (七)能源消耗定额执行情况;

  (7) Implementation status of the energy consumption quotas;

  (八)用能系统、设备节能运行情况;

  (8) Information on the energy conservation operation of energy use system and equipment;

  (九)公务用车使用管理和新能源汽车推广应用情况;

  (9) Information on the use and management of official vehicles and the promotion and application of new-energy vehicles; and

  (十)法律、法规规定的其他事项。

  (10) Other items as stipulated by the laws and regulations.

  第二十条县级以上人民政府管理机关事务工作的机构应当会同有关部门加快节能新技术新产品的推广应用,充分发挥技术节能的作用。

  Article 20

  The office for administering institutional affairs of the people’s governments at the county level or above shall, jointly with relevant departments, accelerate the popularization and application of new energy-saving technologies and products, and give full play to the role of technical energy conservation.

  鼓励高等院校、科研机构、行业协会、节能服务机构参与公共机构节能新技术新产品的推广应用。

  Colleges and universities, scientific research institutions, industry associations, and energy conservation institutions are encouraged to participate in the popularization and application of new energy-saving technologies and products for public institutions.

  第四章节能措施

  Chapter IV Energy Conservation Measures

  第二十一条实行公共机构固定资产投资项目节能评估和审查制度,依法需审批、核准的公共机构固定资产投资项目(含新建、改建、扩建项目)应当进行节能评估和审查。

  Article 21

  The system of energy conservation assessment and examination shall be implemented in fixed asset investment projects of public institutions, and the fixed asset investment projects of public institutions that are required to be approved and verified by law (including new construction, renovation and expansion projects) shall be subject to energy conservation assessment and examination.

  公共机构建筑应当充分利用自然通风和采光,使用高效节能照明产品,优化照明系统设计,改进电路控制方式,推广应用智能调控装置,严格控制建筑物外部泛光照明以及外部装饰用照明。

  The office buildings of public institutions shall make the best use of natural ventilation and lighting, use efficient and energy-saving lamps, optimize the design of lighting system, improve the circuit control mode, promote the application of intelligent control devices, and strictly control the flood lighting and decorating lighting outside such buildings.

  鼓励公共机构采用合同能源管理模式实施既有建筑节能改造,按照合同规定支付给节能服务机构的支出应当视同能源费用进行列支。

  Public institutions are encouraged to implement the reconstruction of existing buildings for energy conservation by contractual energy management, and the expenditures paid to the energy conservation institutions according to the contract shall be deemed as energy expenditures.

  鼓励有条件的项目实施既有建筑绿色化改造。

  The projects that meet relevant conditions are encouraged to implement green reconstruction of existing buildings.

  第二十二条公共机构空调、电梯等系统应当实行智能化控制,加强运行调节和维护保养。

  Article 22

  Public institutions shall subject their air-conditioning, elevators and other systems to intelligent control, and enhance the operation adjustment and maintenance of such systems.

  公共机构应当严格执行国家有关空调室内温度控制规定,除特定用途外,夏季室内空调温度设置不得低于二十六摄氏度,冬季室内空调温度设置不得高于二十摄氏度;非工作时间应当及时关闭空调设备,季节交替期间,应当少用空调,充分利用自然通风节能。

  Public institutions shall strictly abide by the relevant national provisions on indoor air-conditioning temperature, and except for specific purposes, the indoor air-conditioning temperature in summer shall not be set lower than twenty-six degrees Celsius, while the indoor air-conditioning temperature in winter shall not be set higher than twenty degrees Celsius; the air-conditioning equipment shall be turned off timely during the non-working hours, and at the turn of seasons, public institutions shall use less air-conditioning equipment, but make full use of the natural ventilation for the purpose of energy conservation.

  公共机构应当合理设置电梯开启数量和时间,非工作时间应当合理控制使用电梯台数和频率。提倡办公场所三楼以下不使用乘客电梯,高层电梯分段运行,短距离上下楼不乘坐电梯。

  Public institutions shall reasonably set the number of elevators in use and the use time, and shall reasonably control the number and frequency of elevators in use during the non-working hours. Public institutions are encouraged not to use passenger elevators at and below the third floor of the office buildings, to operate high rise elevators by sections, and not to use elevators when going upstairs and downstairs for a short distance.

  第二十三条公共机构应当建立办公设备巡视检查制度,加强办公设备用电管理,减少计算机、复印机、传真机、打印机等办公设备的待机能耗。

  Article 23

  Public institutions shall establish a system of office equipment inspection to improve the power consumption management of office equipment and to reduce the standby energy consumption of computers, copiers, fax machines, printers and other electric-powered equipment.

  公共机构应当按照节约型公共机构建设的要求,积极推进电子政务,加强内部信息化、网络化建设,推行无纸化办公,合理控制会议数量和规模,完善电视电话会议、网络视频会议等系统,减少能源消耗。

  Public institutions shall actively promote e-government affairs, improve the internal information technology and network construction, popularize the paperless office, reasonably control the number and size of meetings, and improve such systems as the videophone conference and network video conference so as to reduce energy consumption in accordance with the requirements for conservation-oriented public institutions.

  第二十四条公共机构应当完善公务车辆管理制度,加强公务车辆的使用和节能管理:

  Article 24

  Public institutions shall improve the management system of official vehicles to strengthen the use and energy conservation of official vehicles as follows:

  (一)优先选用低能耗、低污染、使用清洁能源的新能源车辆,按照规定淘汰高耗能、高污染老旧车辆,严格执行车辆报废制度;

  (1) Giving priority to vehicles which consume less energy, cause less pollution and use clean energy, eliminate old and worn-out vehicles which cause high energy consumption and high pollution, and strictly stick to the vehicle scrapping system;

  (二)建立公务用车能耗台账,定期公布单车行驶里程和能耗,实行单车能耗核算;

  (2) Establishing ledgers for the energy consumption of official vehicles, regularly announce the mileage and energy consumption of each official vehicle, and make the energy consumption accounting with respect to each official vehicle; and

  (三)制定公务车辆节能驾驶规范,避免公务车辆部件非正常损耗,减少公务车辆维修费用支出,降低公务车辆运行成本。

  (3) Formulating the driving rules of official vehicles on energy conservation so as to avoid the abnormal losses of official vehicle components and reduce the maintenance costs and the operating costs of official vehicles.

  第二十五条对公共机构数据中心机房、设备机房、地下停车场、锅炉房等场所能源消耗状况应当实行重点监测,在保障系统、设备正常运行的前提下,应当采取有效措施降低能耗。

  Article 25

  Public institutions shall keep intensive monitoring over the energy consumption in such places as data center rooms, equipment rooms, underground parking garages, and boiler houses, and shall take effective measures to reduce the energy consumption in such places under the premise of ensuring the normal operation of systems and equipment.

  第二十六条公共机构食堂应当建立健全节能管理制度,优先采用环保、节能型灶具和设施设备,加强用水设备的日常巡查和维护管理,减少一次性餐具使用,实行合理配餐、节约用餐,有效降低能源消耗。

  Article 26

  The dining rooms of public institutions shall establish and improve their management systems of energy conservation, give priority to environment-friendly and energy-saving cooking utensils and facilities, strengthen the daily inspection and maintenance of water-using equipment, reduce the use of disposable tableware, and make reasonable catering and energy-saving meals to reduce energy consumption.

  第二十七条推行政府机关办公用房调配和使用集中统一管理,加强办公用房、办公设施设备等的集中整合和集约使用,提高利用效率,减少能源消耗,降低运行成本。

  Article 27

  Public institutions shall make centralized and unified management for the arrangement and use of official rooms, and strengthen the integration and intensive use of official rooms, facilities and equipment, so as to improve utilization efficiency, reduce energy consumption and reduce operating costs.

  第二十八条公共机构应当优先采用节水型器具,加强供水管网和设备的日常巡查、维护保养、运行调节,并定期对本单位用水状况进行统计分析,及时发现、纠正用水浪费现象。鼓励公共机构开展水平衡测试和中水、雨水等非传统水源利用。

  Article 28

  Public institutions shall give priority to the use of water-saving equipment and tools, strengthen the daily inspection, maintenance and operation of water supply network and equipment, make regular statistical analysis of water use status, and timely identify and rectify the acts of wasting water. Public institutions are encouraged to carry out water balance tests and make use of non-traditional water sources such as reclaimed water and rainwater.

  第二十九条鼓励有条件的地区组织公共机构与有资质、实力强的回收企业合作,构建集中管理、规范高效的公共机构废旧物品回收网络,建立定点定期回收机制。

  Article 29

  The regions that have met the required conditions are encouraged to organize public institutions to cooperate with qualified and competitive recycling enterprises in building a centralized, standardized and efficient network for recycling waste and used articles from public institutions, and establishing a fixed-point and fixed-time recycling mechanism.

  第五章监督和保障

  Chapter V Supervision and Safeguard

  第三十条公共机构的节能工作实行目标责任制和考核评价制度,纳入全省节能目标责任评价考核体系。节能目标完成情况应当作为对公共机构及其主要负责人考核评价的内容。

  Article 30

  Public institutions shall implement the objective responsibility system and the performance evaluation system in their energy conservation work, which shall be included into the objective responsibility system and the performance evaluation system of energy conservation of this Province. The accomplishment of the energy conservation objectives shall be taken as a basis for evaluating the performance of public institutions and that of the principal person-in-charge.

  第三十一条县级以上人民政府管理机关事务工作的机构应当设立举报电话和信箱,接受社会公众对公共机构浪费能源行为的举报和投诉。

  Article 31

  The office for administering institutional affairs of the people’s governments at the county level or above shall set up hot-line telephones and mailboxes to receive the reports and complaints from the public about the energy-wasting acts of public institutions.

  新闻媒体应当加强对公共机构节能法律法规和政策的宣传,发挥舆论引导和监督作用。

  News media shall make more efforts in popularizing laws, regulations and policies on energy conservation in public institutions, and play a role in public opinion guidance and supervision.

  第三十二条公共机构违反本办法规定造成能源浪费的,由本级人民政府管理机关事务工作的机构会同有关部门下达节能整改意见书,限期改正,公共机构应当及时落实。逾期不改正的,由有关机关依照职责权限依法追究相关责任人的行政责任。

  Article 32

  Where any public institution, in violation of the provisions of these Measures, causes energy waste, the office for administering institutional affairs of the people’s governments at the corresponding level shall, jointly with relevant departments, issue an energy conservation rectification opinion to order it to make corrections within a prescribed time limit, and the public institution shall effect the opinion in a timely manner. If the public institution fails to make corrections within the prescribed time limit, the relevant departments shall investigate for the administrative liabilities of the relevant persons-in-charge of such public institution according to their respective duties and responsibilities.

  第三十三条公共机构有下列行为之一的,由本级人民政府管理机关事务工作的机构会同有关部门责令限期改正;逾期不改正的,人民政府管理机关事务工作的机构应当予以通报,并由有关机关对公共机构负责人依法给予处分:

  Article 33

  Where any public institution has committed any of the following acts, the office for administering institutional affairs of the people’s government at the corresponding level shall, jointly with relevant departments, order it to make corrections within a prescribed time limit, and if the public institution fails to make corrections within the prescribed time limit, the office for administering institutional affairs of the people’s government shall circulate a notice of criticism to such public institution, and the relevant departments shall impose sanctions on the person-in-charge of such public institution according to law:

  (一)未制定年度节能目标和实施方案,或者未按照规定将年度节能目标和实施方案报送备案的;

  (1) Failing develop its annual objectives and implementation plan of energy conservation thereof, or failing to submit the annual energy conservation objectives and the implementation plan thereof for archival purpose as required;

  (二)未按照规定设置能源管理岗位,未实行能源管理岗位责任制,或者未在重点用能系统、设备的操作岗位配备专业技术人员的;

  (2) Failing to set up energy management posts as required, or failing to implement the energy management post responsibility system, or failing to assign specialized technical personnel to the operation posts of key energy use systems and equipment;

  (三)未实行能源消耗计量制度,或者未按照本办法第十条第一款的规定配备和使用计量器具,未区分用能种类、用能系统实行能源消耗分户、分类、分项计量,未对能源消耗状况进行实时监测的;

  (3) Failing to implement the energy consumption measurement system, or failing to equip with and use the energy measuring instruments in accordance with the provisions of Paragraph 1 of Article 10 of these Measures, or failing to realize household-based, type-based and item-based measurement of energy consumption according to different energy use types and energy use systems, or failing to make real-time monitoring over the status of energy consumption;

  (四)未指定专人负责能源消耗统计,或者未如实记录能源消耗计量原始数据,建立统计台账的;

  (4) Failing to appoint special personnel to collect the statistical data on energy consumption, or failing to record the raw data of energy consumption measurement and set up a statistical ledger;

  (五)未按照规定要求报送上一年度能源消耗状况报告的;

  (5) Failing to submit the report on its energy consumption status in the previous year as required;

  (六)未按照规定进行能源审计,或者未根据审计结果采取提高能源利用效率措施的;

  (6) Failing to make the energy auditing as required, or failing to take measures for improving the energy use efficiency based on the auditing results;

  (七)超过能源消耗定额使用能源,未向本级人民政府管理机关事务工作的机构作出说明的;

  (7) Failing to make an explanation to the office for administering institutional affairs of the people’s government at the corresponding level when the energy consumption is beyond the prescribed quota; or

  (八)拒绝或者阻碍节能监督检查的。

  (8) Refusing or impeding any supervision or inspection on energy conservation.

  第三十四条管理机关事务工作的机构的工作人员在公共机构节能监督管理中滥用职权、玩忽职守、徇私舞弊的,依法给予处分;构成犯罪的,依法追究刑事责任。

  Article 34

  Any staff member of the office for administering institutional affairs of the people’s government, who abuses powers, neglects duties or commits illegalities for personal gains in the administration of energy conservation, shall be imposed sanctions according to law. Where such act constitutes a crime, he/she shall be investigated for the criminal liability according to law.

  第六章附则

  Chapter VI Supplementary Provisions

  第三十五条本办法自2016年6月1日起施行。

  Article 35

  These Measures shall become effective as of June 1, 2016.
